We operate EV Route Log, as well as any other related products and services that refer or link to these legal terms (the "Legal Terms") (collectively, the "Services"). These Legal Terms constitute a legally binding agreement made between you, whether personally or on behalf of an entity ("you"), and Solovyov Oleksiy, concerning your access to and use of the Services. You agree that by accessing the Services, you have read, understood, and agreed to be bound by all of these Legal Terms. IF YOU DO NOT AGREE WITH ALL OF THESE LEGAL TERMS, THEN YOU ARE EXPRESSLY PROHIBITED FROM USING THE SERVICES AND YOU MUST DISCONTINUE USE IMMEDIATELY.
We reserve the right, in our sole discretion, to make changes or modifications to these Legal Terms at any time and for any reason. We will alert you about any changes by updating the "Last updated" date, and you waive any right to receive specific notice of each change. It is your responsibility to periodically review these Legal Terms. Continued use of the Services after any revised Legal Terms are posted constitutes acceptance of the changes.
The information provided when using the Services is not intended for distribution to or use by any person or entity in any jurisdiction or country where such distribution or use would be contrary to law or regulation. Those who choose to access the Services from other locations do so on their own initiative and are responsible for compliance with local laws.
The Services offer a free tier and an optional paid subscription, "EV Route Log Pro," which unlocks tracking more than one vehicle and removes advertising.
Our intellectual property. We are the owner or licensee of all intellectual property rights in the Services, including source code, databases, functionality, software, design, and content (collectively, the "Content"), as well as the trademarks, service marks, and logos contained therein (the "Marks"). The Content and Marks are provided "AS IS" for your personal, non-commercial use only.
Your use of the Services. Subject to your compliance with these Legal Terms, we grant you a non-exclusive, non-transferable, revocable license to access the Services and to download or print a copy of any portion of the Content you have properly accessed, solely for personal, non-commercial use. No part of the Services or Content may be copied, republished, uploaded, sold, or otherwise exploited for any commercial purpose without our express prior written permission. Any breach of these Intellectual Property Rights constitutes a material breach of these Legal Terms and will terminate your right to use the Services immediately.
Your submissions. If you directly send us a question, comment, suggestion, idea, or other feedback about the Services ("Submissions"), you agree to assign us all intellectual property rights in it, and that we may use and disseminate it for any purpose without compensation or acknowledgment to you. By using the Services, you represent and warrant that: you have the legal capacity to agree to these Legal Terms; you are not a minor in your jurisdiction of residence; you will not access the Services through automated or non-human means; you will not use the Services for any illegal or unauthorized purpose; and your use will not violate any applicable law or regulation. If any information you provide is untrue, inaccurate, or incomplete, we may suspend or terminate your account.
You may not access or use the Services for any purpose other than that for which we make them available. As a user, you agree not to, among other things: systematically retrieve data to build a collection or database without our permission; trick, defraud, or mislead us or other users; circumvent or interfere with security-related features; harass, abuse, or harm another person; misuse our support services or submit false reports; upload viruses or other malicious code; use any automated system (bots, scrapers, data-mining tools) to access the Services; attempt to impersonate another user; attempt to bypass measures preventing or restricting access; decompile or reverse-engineer the Services except as permitted by law; or use the Services for any revenue-generating or commercial enterprise competing with us.
The Services do not offer users the ability to publicly post or share content with other users — your vehicle and charging session data stays private to your own account and is never shown to other users. If you send us feedback, suggestions, or other information about the Services, we may access, store, process, and use it, and share it for any purpose without compensation to you. We do not assert ownership over anything you submit; you remain solely responsible for it, and agree not to hold us liable for statements or representations in it.
We reserve the right, but not the obligation, to: monitor the Services for violations of these Legal Terms; take appropriate legal action against anyone who violates the law or these Legal Terms; restrict, disable, or remove content at our discretion; and otherwise manage the Services to protect our rights and property and facilitate their proper functioning.
These Legal Terms remain in effect while you use the Services. We reserve the right to deny access to or use of the Services, without notice or liability, to any person for any reason, including breach of these Legal Terms. If we terminate or suspend your account, you are prohibited from creating a new account under your name, a false name, or a third party's name.
We reserve the right to change, modify, or remove the contents of the Services at any time without notice, and we have no obligation to update any information. We cannot guarantee the Services will be available at all times and are not liable for any loss, damage, or inconvenience caused by downtime or discontinuance.
These Legal Terms shall be governed by and defined following the laws of Ukraine. We and yourself irrevocably consent that the courts of Ukraine shall have exclusive jurisdiction to resolve any dispute which may arise in connection with these Legal Terms.
Informal negotiations. To expedite resolution and control the cost of any dispute related to these Legal Terms, the parties agree to first attempt to negotiate any dispute informally for at least 30 days before initiating arbitration. Such informal negotiations commence upon written notice from one party to the other.
Binding arbitration. If the parties are unable to resolve the dispute through informal negotiation, the dispute shall be finally resolved by arbitration in accordance with the United Nations Commission on International Trade Law (UNCITRAL) Arbitration Rules in force at the time. The number of arbitrators shall be 1. The seat, or legal place, of arbitration shall be Odesa, Ukraine. The language of the proceedings shall be English. The governing law of these Legal Terms shall be the substantive law of Ukraine.
Restrictions. Any arbitration shall be limited to the dispute between the parties individually. No arbitration shall be joined with any other proceeding, and there is no right to arbitrate any dispute as a class action or in a representative capacity.
Exceptions. The following disputes are not subject to the above: (a) disputes concerning intellectual property rights; (b) disputes arising from allegations of theft, piracy, invasion of privacy, or unauthorized use; and (c) any claim for injunctive relief.
There may be information on the Services that contains typographical errors, inaccuracies, or omissions. We reserve the right to correct these and to update information at any time without prior notice.
THE SERVICES ARE PROVIDED ON AN AS-IS AND AS-AVAILABLE BASIS. YOUR USE OF THE SERVICES IS AT YOUR SOLE RISK. TO THE FULLEST EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE ARE NOT LIABLE FOR ANY ERRORS OR INACCURACIES OF CONTENT, PERSONAL INJURY OR PROPERTY DAMAGE RESULTING FROM YOUR USE OF THE SERVICES, UNAUTHORIZED ACCESS TO OUR SERVERS OR ANY PERSONAL INFORMATION STORED THEREIN, ANY INTERRUPTION OF TRANSMISSION, OR ANY BUGS OR VIRUSES TRANSMITTED THROUGH THE SERVICES BY THIRD PARTIES.
IN NO EVENT WILL WE OR OUR DIRECTORS, EMPLOYEES, OR AGENTS BE LIABLE TO YOU OR ANY THIRD PARTY FOR ANY DIRECT, INDIRECT, CONSEQUENTIAL, EXEMPLARY, INCIDENTAL, SPECIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF THE SERVICES, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. OUR LIABILITY TO YOU FOR ANY CAUSE WHATSOEVER WILL AT ALL TIMES BE LIMITED TO THE AMOUNT PAID, IF ANY, BY YOU TO US. CERTAIN LAWS DO NOT ALLOW LIMITATIONS ON IMPLIED WARRANTIES OR THE EXCLUSION OF CERTAIN DAMAGES — IF THESE LAWS APPLY TO YOU, SOME OF THE ABOVE LIMITATIONS MAY NOT APPLY, AND YOU MAY HAVE ADDITIONAL RIGHTS.
You agree to defend, indemnify, and hold us harmless from any loss, damage, liability, claim, or demand, including reasonable attorneys' fees, made by any third party due to or arising out of: your use of the Services; breach of these Legal Terms; breach of your representations and warranties; your violation of the rights of a third party; or any harmful act toward another user.
We will maintain certain data that you transmit to the Services for the purpose of managing their performance. Although we perform routine backups, you are solely responsible for all data you transmit, and we have no liability to you for any loss or corruption of such data.
Visiting the Services, sending us emails, and completing online forms constitute electronic communications. You consent to receive electronic communications and agree that they satisfy any legal requirement that communication be in writing. You agree to the use of electronic signatures, contracts, orders, and other records.
These Legal Terms, together with any policies posted by us, constitute the entire agreement between you and us. Our failure to enforce any right or provision shall not operate as a waiver. If any provision is found unlawful or unenforceable, it is deemed severable and does not affect the remaining provisions. There is no joint venture, partnership, employment, or agency relationship created between you and us as a result of these Legal Terms.
